Special Prosecutor Kari Morrissey’s decision finalizes the legal proceedings against Baldwin, which were dismissed in July due to allegations of withheld evidence.

“Today’s decision to dismiss the appeal is the final vindication of what Alec Baldwin and his attorneys have said from the beginning — this was an unspeakable tragedy but Alec Baldwin committed no crime,” said defense attorneys Luke Nikas and Alex Spiro in a joint statement.

Baldwin, both lead actor and co-producer for Rust, was rehearsing a scene when the revolver he was holding discharged, killing Hutchins and injuring director Joel Souza. Baldwin has maintained that he pulled back the gun’s hammer but did not pull the trigger.

At trial, the case against Baldwin unraveled due to revelations that investigators had failed to disclose evidence, including ammunition introduced to the Santa Fe County Sheriff’s Office months after the incident. The defense argued that this evidence was improperly handled, prompting Judge Mary Marlowe Sommer to dismiss the charges midway through the trial.

In their statement, local prosecutors acknowledged legal hurdles in pursuing the appeal and cited the New Mexico attorney general’s lack of intent to pursue the case further.

“The State’s efforts to litigate the case in a fair and comprehensive manner have been met with multiple barriers,” they said.
