On Thursday, the White House forcefully responded to Texas Governor Greg Abbott’s latest confrontation with President Joe Biden over southern border control. Abbott, a Republican from Texas, raised controversy by labeling the influx of immigrants into Texas as an “invasion” in a statement released on Wednesday. He argued that due to what he perceives as President Biden’s failure to enforce existing immigration laws, Texas has a constitutional right to self-defense. As part of this stance, Abbott vowed to disregard federal attempts to dismantle the razor wire Texas authorities placed along its border with Mexico.


 
In his statement, Governor Abbott accused the federal government, particularly the Executive Branch, of neglecting its constitutional duty to uphold federal laws that protect states, including those governing immigration. He claimed that President Biden’s refusal to enforce these laws and alleged violation of them has led to record-breaking levels of illegal immigration. Abbott’s argument hinges on the belief that the state’s right to self-defense trumps federal law. This position, particularly Abbott’s claim of a state’s right to “self-defense,” remains untested in a legal context, even though the U.S. Supreme Court has ruled that Border Patrol can remove the razor wire.
 
Abbott asserted that the actions taken by the Texas National Guard and other state agencies to secure the Texas-Mexico border are based on this perceived right of self-defense. He had previously instructed these forces to install razor wire in specific border areas, including Shelby Park near Eagle Pass. This has become a significant point of contention in the ongoing dispute between the Texas Governor’s office and the White House.

On Monday, the U.S. Supreme Court’s decision passed with a narrow 5-4 vote marked a significant development in this conflict. The Court authorized federal agents to remove the razor wire, a move that administration officials and immigration advocates had described as both dangerous and inhumane. Following the Court’s decision, the Department of Homeland Security (DHS) issued a letter to Texas, explicitly demanding access to Shelby Park for Border Patrol operations, which had been obstructed by Texas law enforcement under Abbott’s orders.
 
In his communication to Texas Attorney General Ken Paxton, DHS General Counsel Jonathan Meyer emphasized the Supreme Court’s ruling, which annulled a lower court’s injunction against DHS. According to Meyer, this ruling restored DHS’s authority to alter or remove the concertina wire placed by Texas to fulfill its statutory duties. Meyer also contested Texas’ assertion that Shelby Park is open to the public, pointing out DHS’s acquisition of permanent real estate interests in the Eagle Pass area since 2008, which are intended to support the construction and maintenance of border barriers, including in the vicinity of Shelby Park.
 
Despite the Supreme Court’s decision, Governor Abbott persisted in confronting the federal government. He appeared on Fox News, reiterating his accusation that President Biden is shirking his responsibility to enforce immigration laws passed by Congress. Abbott’s unyielding stance was echoed by House Speaker Mike Johnson, who publicly supported the Texas Governor and pledged the House’s backing in this dispute.
 
In the meantime, Texas DPS and the Texas Military Department maintained their presence along the border, with Texas DPS spokesperson Lt. Chris Olivarez sharing footage of National Guard troops reinforcing barriers in the Eagle Pass area. Democratic Representative Joaquin Castro criticized Abbott’s tactics, calling them obstructive and chaotic, and urged President Biden to take decisive action to establish sole federal control over the Texas National Guard.
 
John Cohen, a former high-ranking DHS official, criticized Abbott’s interpretation of the situation. Cohen, speaking as an ABC News, linked Abbott’s use of the term “invasion” to ideologies commonly associated with white supremacists. He highlighted the humanitarian crisis at the border, pointing out the dire circumstances that compel people to flee their home countries due to poverty, violence, and public health issues, seeking refuge and safety in the United States under international agreements and federal law.
